I have no idea if it is legal or not, the files aren't in .drs format so it's hard to say. Check the Licence Agreement to see if there is anything against it. I know that you aren't allowed to decompile/reverse engineer anything but these are just files in a different audio format.
This is taken from the Rise of Rome EULA. I guess you have to get permission from Microsoft before you can use the files.
