madwifi and toshiba A70


I have a problem with my built in wireless on my laptop. i know it works, it has worked on some of the live cd's.
i have madwifi installed

lsmod shows. (greped ath)
ath_pci 51616 0
ath_rate_onoe 6920 1 ath_pci
wlan 103900 3 ath_pci,ath_rate_onoe
ath_hal 146512 2 ath_pci

iwconfig shows
lo no wireless extensions.

eth0 no wireless extensions.

note the essid is mine and the mac of the ap is mine. it finds that info.

eth0 is hot because i need a connection to post this. if i leave it unpluged it simply dosent show.
if i assign an ip it just shows the ip and still is not connected.
if i dhcpcd it times out.
i can also
iwlist ath0 scan and pick up the 4 ap's that are around me. but still cant connect.
have checked ap and nothing id blocking it. it has full access, as much as i hate to speak the "w" work. its works as it should in winDOHs.
i know it has to be something simple but i appear to be snake bit.
any suggestions?
