kernel 268 wont allow vfat mount

I have sarge installed woth both the 2.4.27 & 2.6.8 kernels

2.6.8 wont allow me to mount my data partition as vfat, only as msdos.

2.4.27 & my other debian based distros all mount it as vfat.

I have vfat, dos,ntfs,ext3,ext2 built into the 268 kernel.

could this be a kernel config problem or a bug in the 268 kernel?
